Terms & Conditions
GENERAL TERMS AND CONDITIONS FOR PURCHASES
Fasser GmbH Zugspitz Bike
Unterdorf 14/3, A-6631 Lermoos
The following General Terms and Conditions apply to the purchase of goods from our bicycle specialist store.
1. Purchase Price; Retention of Title in Case of Financing
1.1 Unless otherwise agreed, the purchase price is due immediately upon receipt of the invoice without any deductions. In the event of default, we charge the statutory default interest.
1.2 In the case of purchase price financing, we retain ownership of the goods delivered by us until full payment of the purchase price and any incidental costs. If you fail to make a payment on time or at all, we may withdraw from the contract under statutory conditions.
2. Defects, Warranties
2.1 Claims for defects that were known to the customer at the time of contract conclusion or acceptance are excluded, unless the customer has expressly reserved their rights.
2.2 For new goods, we are liable according to statutory regulations. We may refuse performance if the customer does not provide the claimed goods for inspection despite a request. We decide whether the defect is remedied by repair, replacement, or new production.
2.3 Statutory limitation periods apply. However, for used goods, the limitation period for claims for supplementary performance and for rescission due to defects is one year from delivery. This reduction does not apply in cases of fraudulently concealed defects or defects for which we have provided a guarantee.
2.4 Information and illustrations in order confirmations, brochures, or other documents do not constitute guarantees. Guarantees or warranted characteristics only exist if explicitly stated as such by us or designated as such in the product documentation.
3. Liability for Damages and Reimbursement of Expenses
3.1 In the case of slight negligence, we and our agents are only liable for breaches of essential contractual obligations (i.e., those whose fulfillment makes the proper execution of the contract possible and which you may regularly rely on). In such cases, liability is limited to the typical and foreseeable damages and expenses.
3.2 The above exclusions and limitations of liability do not apply to:
Assumption of a guarantee
Fraudulent concealment of a defect
Injury to life, body, or health
Liability under the Product Liability Act
Cases of gross negligence or willful misconduct
GENERAL TERMS AND CONDITIONS FOR WORKSHOP SERVICES
Fasser GmbH Zugspitz Bike
Unterdorf 14/3, A-6631 Lermoos
1. Scope of Application
These Workshop Terms and Conditions apply to all contracts for repair, maintenance, and other workshop services with our customers. The customer's own terms and conditions or amendments to these T&Cs are valid only if explicitly accepted by us.
2. Contract Conclusion
2.1 A contract is concluded when the customer places an order and we accept it.
2.2 In individual cases, we reserve the right to require an appropriate advance payment upon order placement.
3. Prices
3.1 Our services are billed according to the price list valid at the time of contract conclusion.
3.2 For foreseeable major repair services or upon customer request, we will provide a cost estimate. This estimate is prepared to the best of our ability but without guarantee for its accuracy or completeness. If additional work or parts are required during execution, these must also be paid for. If the overall estimate is clearly exceeded, we will notify the customer without delay. In this case, the customer has the right to cancel the contract, but already performed services must be paid for.
4. Completion Date
4.1 Completion dates are binding only if explicitly agreed with the customer. Even in such cases, we are not responsible for delays resulting from unforeseen changes or extensions to the scope of work. We will then provide a new completion date.
4.2 After notification of completion, the customer must collect the bicycle or other item within two weeks. If this period is exceeded, we may charge reasonable storage costs, which we determine at our discretion and which may be reviewed by a competent court. After one year from notification, and after at least three collection reminders, we may dispose of the item at our discretion. Any remaining proceeds, after deducting our claims (including fees and storage costs), will be paid to the customer upon request.
4.3 If the customer requests delivery of the bicycle or item after completion, it will be done at the customer’s expense unless otherwise agreed. Delivery costs are determined and agreed individually. We are not obliged to offer delivery.
5. Payment
5.1 Our invoices are due immediately upon collection or delivery, in cash and without deductions. If the customer does not collect the item within the two-week period (see Section 4.2), we will send an invoice, which must be paid immediately upon receipt.
5.2 In addition to the statutory contractor’s lien, we have a contractual lien on items in our possession due to outstanding payments. This also applies to previous work or deliveries related to the item.
5.3 Accessories or spare parts installed by us remain our property until the invoice has been paid in full and is uncontested. Removed parts replaced by exchange parts become our property.
6. Defects and Compensation
6.1 Claims for defects in our services expire one year after collection/delivery of the item, unless the defect was fraudulently concealed or we have provided a guarantee. This reduction does not apply if statutory warranty provisions under purchase law are relevant.
6.2 Obvious defects in services or parts must be reported by the customer within 14 days of collection or delivery. In the event of a defect, we are entitled to two attempts to remedy the issue, provided we have not given a guarantee or fraudulently concealed the defect. Measures taken to correct defects (including replacement parts) are performed solely to fulfill our warranty obligation for the original service. No new warranty rights arise for the correction itself, and the warranty period is not renewed.
6.3 The above provisions do not apply to damage claims or reimbursement of expenses due to defects. For such claims, Section 7 applies.
7. Liability
7.1 We are generally not liable for damages or expenses caused by slight negligence (including by our agents). This does not apply to breaches of essential contractual obligations. These are obligations that are vital for the execution of the contract and which the customer may rely upon.
7.2 We are not liable for unforeseeable damages or expenses caused by us or our agents.
7.3 If liability for slight negligence is not excluded under Section 7.1, our liability is limited to typical and foreseeable damages or expenses.
7.4 The above exclusions do not apply to:
Guarantees
Fraudulent concealment of defects
Injury to life, body, or health
Liability under the Product Liability Act
Gross negligence or intentional acts
